From buying and selling your property to arranging a Power of Attorney for someone to take over responsibility to ensure that your affairs are dealt with carefully and safely, our experienced Elderly Client Services team can provide honest, professional advice and assistance.
Power of Attorney
The Power of Attorney enables a person who has capacity and is over 18 (the Donor) to choose another person or people (the Attorney(s)) to make decisions on their behalf. You can give the Attorney(s) a general power to do anything which you could do yourself, or you can restrict their powers to only deal with certain assets/processes.
In addition, Powers of Attorney can be used if you are planning to travel abroad and are unable to complete paperwork. An ordinary Power of Attorney will come to an end if you lose mental capacity to make decisions.
Lasting Power of Attorney (LPA)
Health and Welfare LPA - these are for decisions about health and personal welfare, such as where to live, day-to-day care or having medical treatment. A health and welfare LPA can only be used once it has been registered with the Office of the Public Guardian and after the donor has lost mental capacity.
Property and Financial Affairs LPA - for decisions about finances, such as selling the Donor's house or managing their bank account. A property and financial affairs LPA can be set up to come into force as soon as it is registered, or the donor can restrict it so that it can only be used if they lack mental capacity.
Deputyships
Unlike a Power of Attorney, a Deputyship may be required for a person who lacks mental capacity but has assets that need to be administered or decisions taken about their welfare. A Deputy is appointed by the Court of Protection to manage the personal welfare or the property and affairs of the person who lacks mental capacity.
Our Elderly Client Services team also provide plain English advice on estate and inheritance tax planning, setting up trusts and equity releases. We are happy to do home or hospital visits if you are unable to come into the office.
